opine. do not be verecund. again, thanks for watching tonight. ms. megyn is next. i'm bill o'reilly. please always remember the spin stops here because we are definitely looking out for you. breaking tonight a troubling milestone. the number the of americans being kicked off their health care plans has now topped at least 4 million. 4 million people nationwide. as the president addresses the health care controversy again, just a short time ago tonight. welcome, everyone, to "the kelly file." i'm megyn kelly. we'll get to the president in a minute. we got word a while ago from the colorado department of insurance a quarter million people have been kicked off of their plans in that state. despite the president's repeated promises that they could keep their insurance and their doctors under obama care. that brings our totals now to more than 4.2 million americans losing coverage in recent days. it comes as calls continue to

build for president obama to come clean about his broken promises. from the left, from the right, from the mainstream media, from his critics and supporters, we are now hearing more people come out and say the president needs to the level with the american people about why he told them at least 36 times before, during and after the passage of obama care that if they liked their plans they could keep them, period. tonight in the wake of the mounting pressure he took to the microphones in a speech about the health care law and said this. >> the first month i have not been happy with. you have all heard about the website woes. nothing drives me more crazy than the fact that right now there is great insurance to be had out there except too many folks haven't been able to get through the website. this is like having a really

good product in the store and the cash registers don't work and there aren't uh enough parking spots and nobody can get through the door. if people can't get true the website, they can get on the phone to the call center and people can apply in person. part of the affordable care act was expanding the gnumber of working families who would qualify for medicaid. nothing will stop us from getting this done. we are on the right side of history. >> marc thiessen is a former speech writer for george w. bush. where was it? where was the mea culpa, the come to jesus, the acknowledgment that he misled millions of people in this country who now 4.2 million of which, so far, have been kicked off their plans, contrary to his direct promise. he's talking about having a great product in the store and can't get in to buy it.

>> i'm sorry i misled you. that's what was missing the in the speech. the site says if you like your health insurance you have, you can keep it, period. it's on the white house website. they have not acknowledged the basis fact that this administration misled the american people. when he says these things, nobody is listening. there is a crisis of credibility. nobody will listen to a word he says until he comes out and tells the american people, i misled you. what i said was inaccurate. i'm sorry. let's move on. >> he's not doing it. >> no. >> i don't know why we have that. you can take it off. it's distracting. his favorability is dropping. >> yeah. >> his job approval. favorability is key. all along despite scandals and so on, the irs, benghazi. people still liked him. for the first time this week we saw it changing. more people disliked than liked. job approval dropping. the question is can the man who promised to have the most

transparent administration ever get away with this, marc? >> he can't. look, people don't like being lied to. when the president of the united states says to you that you can keep your health plan no matter what, period. and it turns out he knew it wasn't true they are not going the to give you a second chance until you fess up. by dragging this out, he's making it worse for himself. the cover-up is worse than the original scandal. >> okay. but as somebody who used to the traffic in presidential language, how can he do it? la n lany davis is coming up. he's going the to say the president should say, look, i oversimplified it. we have been discussing your belief for a couple of days now that it wasn't over simplification. he had to do it. >> yes. >> he had to mislead because the plan was to devastate the individual insurance market because guess who's in it.

you tell the people. >> healthy people who don't use a lot of services. they need those people to move into the exchanges in order to subsidize the poor and sick. they need this. this was planned from the beginning. it was part of it. they wrote the regulation to ensure that the vast majority of plans in the individual market and the small group market wouldn't qualify for grandfathering. this was part of the plan. there is nothing he can say that changes this until facts on the ground change. that when millions of americans are losing health insurance it doesn't matter what the president of the united states says. i worked for president bush during the iraq war in 2006. we would give speeches talking about how our strategy was working and troops on the ground and the morale was great. it didn't mesh with what people saw on the tv screens. it was only when the strategy changed and we acknowledged that we were mistaken and did something different that people started -- numbers started moving. until the reality on the ground changes nothing will change. >> one thing changing in

washington is the dynamic amopg democrats who voted for the law. especially in the tight race in virginia which came down to obama care. people's dislike for it. now we find out today in a meeting that was not scheduled, not publically announced the president called in all these top democrats running for re-election in the senate. the very dozen who voted for the law met with the president tonight. spicy conversation about politics, marc. >> yep. >> what are these dozen going to do? >>they are in big trouble. the president needs to admit he knew. but the democrats knew as well. it's not just their vote on obama care. mary landrieu and all these other senators are going out there. shaheen from new hampshire are saying they are shocked that millions of people are losing health insurance. we didn't know it would happen. we were told people could keep their plans. not only did they know millions of people would lose their

plans. they voted to kill legislation that would have saved their plans. you had mike enzi on. three years ago he went out on the senate floor and said millions of people will lose their plans because of the regulations. he offered a bill that would have saved their plans and every single democrat voted no. >> they accused him of fear mongering. >> exactly. >> he's been prove right. >> he has been. >> marc, thank you. >> thank you, megyn. >> there is another story tonight regarding kathleen sebelius. she returned to capitol hill to answer questions on the problems with the obama care rollout and the law itself. the president's promise that if you like your plan you can keep it. watch this. >> the white house website says if you like your plan, you can keep it and you don't have to change a thing due to the health care law. we know that lying to congress is a crime. unfortunately lying to the american people is not. i'd just like to ask you a simple true or false question.

is that statement on the white house website true? or is it false? >> sir, i think the statement -- >> is it true or false, madam secretary? >> the vast majority of american who is are insured are in the employer market, are in public plans or veterans plans. those plans have stayed in place and continued to offer benefits. >> republican john cornin of texas is a member of the senate finance committee. he's with me now. why is it impossible to get a straight answer on this critical issue to the american people? >> you know, if we were in a courtroom the judge would have instructed her to answer the question. but we weren't. she didn't answer the question. i think because she knows the only honest answer is that it's not true. it's a false statement on the website and the 30-something times the president repeated it.

now they are main a tight spot. the meeting with the democrats up for re-election in 2014, they are in a meltdown mode and panicking because they realized they are in an impossible situation. >> she's not just the president's mouthpiece on obama care. she's the chief executioner. she went out and passed the regulations tightening the noose around insurance companies such that almost no plans would be grandfathered as the president said they would be. was she held to account for that? can she? you said it's almost impossible to get fired in this administration. >> that's true. others called for her to resign. i have joined the call today. there's got to be accountability. if there is one thing people are frustrated with washington about it's people mislead the public. today do a terrible job. they harm the public interest and nothing seems to happen. i think it's time for her to go.

what most people haven't focused on is this is more than just about a website. the president in your clip was talking about the website. they are going to fix that. what they are not going to fix. what they know they did was mislead the american people. tens of millions of people will lose their health care coverage they liked just fine. >> the other crazy thing -- and you raised it today b about the navigators supposed to help people with the process can be convicted felons. tens of millions of people kicked off plans they liked, forced into health care.gov exchange they want nothing to do with and they were promised they would never have to deal with on a website that doesn't work and when it does the person helping them navigate it might be a convicted felon with access to their most private information. let me play the clip of you with ms. sebelius today on that. >> isn't it true that there is no federal requirement for

navigators to undergo a criminal background check though they will receive sensitive personal information from the individuals they helped sign up for the affordable care act? >> that's true. states could add ap additional background check and features. it is not part of the federal requirement. >> so a convicted felon could be a navigator and could acquire sensitive personal information from an individual unbeknownst to them. >> that's possible. >> the insult to the american people, sir. >> yeah. you can't make the this stuff up. this is just beyond bizarre. they didn't plan for all of these various contingencies. basically sold the american people a bill of goods. now the birds are coming home to roost. i think that's where the panic is starting to set in, particularly on this party line vote. this is unusual in a lot of ways. unlike a lot of major pieces of

legislation that have bipartisan buy-in, this is strictly a party line vote. no republican voted for this in the house or senate. it's just the democrats and the ones up for election are worried about it. >> these people have been kicked off plans contrary to the promise and have to deal with a possible convicted felon in logging onto the obama care website. have to tag the risk. you have to go for it. right now that's the situation. you heard ms. sebelius say it is possible. hand over your social security numbers. outrageous. senator, thank you. >> thanks, megyn. >> we'll see what they do. why did the big insurance companies call the white house and ask for a meeting yesterday like the senate democrats the insurance companies aren't happy. we have answers about what they are unhappy about tonight. plus, do you know the name edie sundby yet? you have heard about the op-ed in the wall street journal likely. she has stage four cancer.

on "the kelly file" tonight a health care story getting international attention. edie sundby is a wife, mother and a stage four cancer survivor about to lose her health care plan like the millions we reported on at the top of the hour. when the 62-year-old wrote about her struggle in the wall street journal the white house directly challenged her account. no empathy offered. a challenge was offered suggesting she was incorrect about the, quote, real reason she lost her coverage directing people to a left-leaning blog suggesting she was losing the plan because of her insurance company's greed, not obama care. joining me tonight, edie sundby. thank you very much for being here. to your credit you never wanted to make it a political issue. you say you are a registered

independent, have voted for as many democrats as you have republicans. the response from dan pfeiffer on a white house twitter account to your personal tale of what's happened to you didn't make you happy. tell us. >> i'm very, very grateful to be alive. i know how lucky and blessed i am to be alive. the two things i think that are of utmost important, the reason i'm alive today is because of my medical insurance and because of my doctors. i find myself in a very uncomfortable and very stressful situation that's a bit overwhelming. my insurance company as pulled out -- completely pulled out of the individual market in california. >> right. >> that's united health care. the largest insurer in the country. they have pulled out completely

from the individual market in california. they're gone. of course my policy is gone. i have a termination note or a cancellation letter just like the other 10 to 15 million americans out there receiving these cancellation letters. so i don't have my insurance company that i love. i don't have the medical policy, the health policy that i love and trust. and now if i go in a health exchange, i have to choosedocto >> right. choose between your primary care doctors or your cancer doctors. that's not a choice you want the to make. the administration told news the wake of the news that over 10 million americans are likely to lose insurance that these are lousy plans. these were substandard plans that needed to go. and they are doing people a favor basically by forcing you off of them. >> that's absurd.

frankly it's ko eecondescendinge it's not true. i feel like a loser in this because i have lost my medical insurance and potentially could lose my doctors. the biggest loser here is trust and respect for government. trust and respect for our leaders. i hate to say that. i really hate to say that. i can only speak for my plan and my story, but my plan was fabulous. i took out this plan that's a catastrophic ppo plan with united health care called pacific care because it's a california market. since 2005 it has been fantastic, giving me total freedom to choose. i have been with this plan to sloan keterring in new york, md anderson in houston. i have a rare and aggressive gallbladder cancer. it's very late stage.

it's come back just in the last two years it came back viciously p in my liver and lung again. so i have had to fight. that's how cancer is. you can fight, fight and think you're winning but it's sneaky. >> and the ongoing relationship with your doctors is so critical. i know united pulled out of the market for various reasons, but the c ereo was explicit that ob care tipped the scales. the white house rejected that. i have to run. i will give you a quick last word on the tweet challenging your account. >> you know, i just didn't understand why they felt that was necessary. because let's fix this. it's so complex. it's unbelievably complex and confusing.

after months of pressure from the unions the obama administration is reportedly about to announce a tax break for big labor undew about the r? think you will get the break, too? justin miller is from the union facts. the unions have been all over the president. they wanted him to give them the same subsidies that people applying for insurance in the individual market would potentially get. you're not allowed to get that

with union based insurance. the administration couldn't do it because the law says no. they found this back doorway of making life easier for just them. it's basically a big tax break and looks like the administration may now push for it. >> we've got maybe upwards of 10 or 15 million americans giving cancellation letters. the unions spent $4 million to get the president elected twice are getting payback. president obama originally said there is nothing i can do. the plans may go bankrupt. we may have to dump another ten million people into the exchange. the unions went public with disdain for the president and we had republicans touting the fact that you had teamsters calling for a repeal of the plan. a few days ago the administration slipped something into the regulation. >> kathleen sebelius. >> and they are going to exempt pl plans. it's so specific only union plans will be exempted from paying up to $600 million into a

fund -- the fund is the one intended to prevent plans from going into a death spiral. i don't know where they will get the $600 million they are not charging the unions but i imagine they will look at businesses for that. >> that's the question . once again, where does the money come from? why do the unions get the tax break the rest of the american people don't get? nobody is covering this story. >> exactly. they call these cadillac plans during the debate about obama care. the plans provide for hair plugs, free viagra, just about anything you want. the only thing they don't provide for is being picked up from your house in a cadillac and driven to your doctor. they are so expensive every employer is looking at the union saying the plans will put us out of business. where are you then? they have to dump their employees into the exchanges. it's hard to explain how angry they were at the administration. we have never seen the unions come out so hard against president obama until they had

what went from a cold war to a hot war. now he's buying their silence with a $600 million payback. we had the corn husker pay theback, the louisiana purchase, the i will call this the big labor bailout. >> the unions made a raw political argument that they helped president obama pass the law and they deserve to be taken care of. apparently their argument prevailed. quick question. how do they get it through? so president obama can do it with the stroke of a pen? does anybody have to sign off on it other than them? >> the unions were arguinging there were regulatory gymnastics that would allow them to get the same subsidies people on the egs changes could get. >> they can't. the answer is no. >> but this is not necessarily prohibited. i wonder how this balances the wugt for the plan. we have just exempted another $600 million minimum from what

from the world headquarters of fox news it's "the kelly file" with megyn kelly. >> breaking news from the top of the hour tonight, more than 4.2 million americans have been cancelled by their insurance companies. their plans have been. among them a married pair of loyal democrats who donated their time and money to the president's re-election and health care reform. now they say they have been victims of obama care. trace gallagher is live in the west coast newsroom. >> reporter: he's 60-year-old lee hammond. she's jo ellen brothers. they are married , live in san francisco. they are huge fans of the president and worked on his re-election campaign. kaiser permanente told testimony in september their plan was being cancelled. the couple told a website they felt blindsided but felt like it would all work out. kaiser said they would be transitioned into a new plan automatically.

remember why the president said these plans were being transiti transitioned. play this. >> fewer than 5% of americans have cut rate insurance that doesn't offer protection in the case of a serious illness or accident. >> let's compare the so-called cut rate plan to the new one. the old deductible $4,000. new, $4500. out of pocket was $5600. new one is $6350. doctor visits, emergency room visits, hospital stays and prescription medication will all go up under the new plan. here is the bombshell. the premium goes from $558 per month to $1208 per month. they wrote to their congresswoman who happens to be the "you've got to pass it to see what's in it" congresswoman

nancy pelosi saying we believe the act is good for health care, the economy and the future of our nation. however a krrgs a options for middle income individuals ages 59 and 60 are unaffordable. we are learning that many others are similarly affected in that spirit we ask that you fix this for all of our sakes. for the record, kaiser permanente said their current plan, the old one is very good. they are not changing political affiliations but they have gotten a lot of pushback for coming public. they are very disappointed p in the new law. megyn. >> thank you. joining me now a veteran white house adviser and former special council to president clinton and a fox news contributor, lanny davis. stories like that in part we believe led to the dozen or so democrats having a meeting with president obama tonight to say what are uh you going to do about this. what's going to be done? forget broken promises.

as a pure political matter they are likely to be held accountable next fall. >> congratulations first of all on a great show. i have followed you for a long time. i'm a supporter of the affordable care act. my dad, since harry truman first introduced and endorsed legislation for national health care taught me that everyone uh should have access to quality health care. this has gone wrong. we democrats like myself who supported this legislation need admit that it's gone wrong. president obama needs to tell the american people he under estimated the number of changes that would occur by regulation that would cost more money, causing people to lose their health insurance policies. he needs to say, i'm going to fix this by going back to the regulations that caused higher costs than anticipated. >> number one, if marc thiessen

is right, the president won't fix it because this was the plan all along that the administration needed 10 million plus people to lose coverage so they would be the payers in the new market to fund the law. they would be the 7 million the administration is looking for on the exchanges. the second part is this. if he comes out and says, i oversimplified? is it possible now having said it 36 times, keep your plan, period, without reservation. now when people are losing the plans he didn't do it. what i always said was, what i said was you can keep your plan if it isn't cancelled. >> i'm a crisis manager. i look at bad facts. in this case applicable to me as well as president obama. we didn't say it right. we should have said this is going to the cost you more for more coverage. rather than you are never going to have to worry about losing a

policy we should have said you are going to have to increase your premium to get more coverage. now that we know we didn't say it right and we have regulations imposing costs we can maybe get rid of, the president could say, you know, when something is broken, fix it. i didn't do it intentionally. i believe he didn't intentionally mislead people. i think he needs to address the fact that it needs to be fixed. i support this legislation. >> let's give the president the benefit of the doubt. when he was saying, period, period, he didn't have it in his head that it wasn't period, it was asterisk, ellipses. there was ap article in the wall street journal that talked about what white house aides knew and the political folks went to the policy folks -- reverse that. the policy folks went oh the political folks. >> or both. >> and said what he's saying is not right. millions will lose their policies. they knew and the political

folks said, keep your mouths shut. if you like your plan you might be able to keep it. doesn't sell as well as the message he has now. if that's the case, how can he come out and say, i'm sorry. isn't he responsible for what happens in his white house? >> i'd like to think that didn't happen. i would like to see the reporting and proof. if the it did happen it's wrong and the president of the united states running the white house should say it's wrong. they can forgive when somebody is honest and full disclosure. >> you had that in the clinton years. >> i learned that in the clinton white house. tell it all, tell it early, tell it yourself. it being the truth. we democrats believe in this legislation. i still do. we have a problem technically. the websites aren't working. we are not using private sector websites that are available until the federal sites worked.

over 4.2 million people have been kicked off of their health care plans. the administration and top democrats have been blaming the insurance companies. yesterday some of the top insurance execs asked the white house for a little sit-down. joining me now, the president of health policy and strategy associates. he liaisons with some insurance companies and has his finger on the pulse of the market. thank you for being here. what do you make of what's clearly emerging as the administration's defense of the cancellation of plans which is insurance companies are bad. they do what they are going to do. that includes cancelling people. they do it all the time. they did it before obama care. they will do it after. don't look at us. >> does anyone in america think the insurance industry would have cancelled 4.2 million customers on virtually the same day if it weren't for obama care? by the way, your 4.2 million number is an interesting one. that's what the count is up to. it will get much higher.

we'll have cancellations going into 2014. >> how high do you think it will go? >> i think 80% of people in the individual health insurance market will lose insurance because of this. the grandfather provisions the administration wrote are so stringent, very few health insurance policies will survive. >> so when you hear kathleen sebelius and president obama say, look, it's the insurance company. we said you could keep your policy if the insurance company didn't change that policy. is that false? should they have known their own regulations would lead to the insurance companies doing that? >> they absolutely knew. the reason they knew it is the insurance companies during the regulation comment period sent specific letters as part of the official comment and regulations before they were issued saying

this was going to happen. >> when kathleen sebelius in the summer after obama care became law offered these regulations in the federal register which basically eliminated the grandfathering for all intents and purposes. they said your plan would be grandfathered in and it wasn't. the insurance companies wrote, spoke out publically and said, hold on, ms. sebelius, president obama. we want you to know what you are doing with this is basically eliminating the individual insurance market. >> it's in the record. this administration, when the computer system crashed, they immediately blamed the subcontractors. now when millions of policy cancellations are going out, it's the insurance industry. when is the this administration going to take responsibility for the rollout of obama care. i have to wonder here given the way this cancellation fiasco has been handled, given the way they have rolled out the computer systems. you know, they are messing with

one-seventh of the economy here with obama care. they are messing with millions of people's health insurance. if they believe these things. if they actually believe them they do not understand how the health insurance market works and why are they messing around with it? >> a promise was made repeatedly. the administration needs those things. the 10 to 15 million people in the market to make it work. they knew uh they would be cancelled and they were fine with it because they needed those people in the exchange. is that possible in your mind? >> yeah, it's possible. do they want everybody in the exchanges because they want everyone in the same utopian health care plan? people have had choices before but now you will have gold, silver and bronze. if the people are healthy why would the insurance companies

cancel them? >> exactly. will it work? whether it was a plan or not, if the people weren't going to health care.gov to sign up but now they basically have to is this regulation by kathleen sebelius going to save obama care at the egs pence of people in the individual market? >> no. the insurance companies already have these people. they were already part of the vinl health insurance pool, if you will. keeping them keeps you where you were. the question now is are we going to get enough healthy people signing up in the additional pool or the new pool, if you will, to pay the claims. there is a front page wall street journal article today that said at least in the beginning, you know, we are getting the older, sicker people which we thought. it makes sense because they are the only ones that will fool around with the computer system. >> won't do them any good now. it's shut down from 1:00 a.m. to

education standards known as common core. trace gallagher has that live in the west coast newsroom. trace? >> the critics are using this english lesson as an example. it's supposed to teach students about the civil war and lincoln. if you look at page 76 there are six sentences that describe the president's job. numbers one, two, three critics have no quarrel with. four through six are ruffling feathers. number four reads, quote, he makes sure the country's laws are fair. critics say it's wrong, partisan and the judicial branch is in charge of making sure the laws are fair. number five, government official commands must be obeyed by all. the critics say it runs contrary to the constitution. number six reads an individual's wants are less important than the nation's well-being. they call that marxist and against american principles of exceptionalism.

a group opposing common core says we are doing a disservice to this generation and the next if we present them with one side of the argument and bombard them with ideas contrary to the american ideal. in doing so we allow our children to be indoctrinated instead of educated. pearson education says, as with all of our materials they underwent a the thorough development and review process. still we are always open to improving our work and we appreciate hearing from you and others with these concerns. they say they will revisit the lessons but common core in the next couple of years hopes to be standard in kindergarten through high school in every state. megyn? >> read what your child is reading. trace, thank you. in all your spare time. still, you have to do it. my kids are little. they can't read. so it's easy. but it's coming. we are taking your comments
